Can damages be recovered if the victim in a personal injury case dies?

Posted on April 27th, 2010 No Comments

Because of the length and nature of personal injury cases, victims sometimes die before the case is settled or goes to court. When this occurs, some amount of the damages may be able to be recovered.

If the victim dies as a result of injuries related to the personal injury case, then the victim’s heirs may recover the damages through a wrongful death case. On the other hand, if the victim dies for reasons not related to the personal injury case, damages may still be recovered by the victim’s executor or other representative of the victim’s estate.
